We would like to inform you about the changes in the use of data boxes.
On 1st February 2022, an amendment to Act No. 300/2008 Coll., on electronic acts and automatic conversion of documents, which changes the rules for receiving so-called postal data messages, has entered into force. Postal data messages are data messages sent by entrepreneurs and non-entrepreneurs in the private sector (such as invoices, notices or orders). This kind of data message replaces the registered letter.
The new rule is that anyone who has set up a data box will automatically be receiving postal data messages from 6th February 2022 onwards. Only natural persons can make their data box unavailable for receiving of these data messages, this is not possible for legal entities.
Please be aware that the 10-day legal fiction of delivery also applies to postal data messages. That means, that in case of failure to log into the data box, the document is deemed to have been delivered after the expiry of the 10 days period.
